Thomas W. Williams, Jr.:  concentrates in public utility law, an area in which he has practiced for more than 20 years. Mr. Williams has represented and advised public utility companies and common carriers providing electric, telephone, water, sewer, barge and trucking services on state and federal laws regulating utilities, contract negotiations and general business law, and has represented such companies in numerous contested case hearings before the Hawaii Public Utilities Commission, as well as in appellate proceedings. Examples of reported decisions are:
  • Rate Cases:
    134 P.U.R.4th 418 (1992) (approving $124 million rate increase).

  • Transmission Lines:
    151 P.U.R.4th 30 (1994) (approving 138 kV overhead transmission line).

  • Power Purchase Agreements (PPAs):
    108 P.U.R.4th 533 (1989), upon reconsideration of 105 P.U.R.4th 59 (1989) (approving a 30-year PPA for a 180 MW coal-fired cogeneration facility and utility recovery of PPA costs).

  • Integrated Resource Planning (IRP):
    134 P.U.R.4th 62 (1992), modifying 131 P.U.R.4th 535 (1992) (establishing a framework for IRP).

  • Accounting Changes:
    158 P.U.R.4th 392 (1994) (approving SFAS 106 accounting for nonpension postretirement benefits, and utility rate recovery of added expenses).

  • Rate Case Appeal:
    In re Hawaiian Electric Co., 698 P.2d 304 (Haw. Ct. App. 1985) (remanding rate case issue).

  • Federal Court Action (co-counsel):
    Hawaii PUC vs. Hawaiian Tel Co., 698 P.2d 827 (9th Cir. 1987) (affirming U.S.D.C. decision enjoining Hawaii PUC pursuant to the Federal Communications Act), cert. denied, 101 L. Ed. 2d 906 (1988).

Mr. Williams has also represented trustees and administrators of multi-employer benefit plans in ERISA fiduciary responsibility litigation, and currently serves as counsel to several multi-employer plans. He has been awarded an AV® rating by the Martindale-Hubbell Law Directory, and is one of two Hawaii public utility law practitioners listed in Best Lawyers in America (1995-1996). Mr. Williams was an Echols Scholar at the University of Virginia where he received a Bachelor of Science Degree in Physics in 1969. After serving in the United States Army, he attended the University of Virginia Law School (J.D., 1975) where he was a member of the Order of the Coif and the Editorial Board of the Virginia Law Review.
